1. Agreement to Terms
By accessing or using OurCast ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
OurCast provides an AI-powered video processing service that allows users to replace faces of characters in movie clips with faces from user-uploaded photos. The Service includes:
- Access to our library of movie clips
- AI face replacement technology
- Video processing and rendering
- Downloadable personalized video content
3. User Accounts and Registration
To use certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
4. User Content and Conduct
You retain ownership of photos and content you upload to the Service. By uploading content, you grant OurCast a limited, non-exclusive license to process and use the content solely for providing the Service.
You agree not to:
- Upload photos of individuals without their consent
- Use the Service for any illegal, harmful, or fraudulent purposes
- Upload content that infringes on intellectual property rights
- Attempt to reverse engineer or exploit the Service
- Share or redistribute generated content for commercial purposes without authorization
- Upload explicit, violent, or otherwise objectionable content
5. Payments and Pricing
The Service operates on a per-movie or bundle pricing model. All prices are displayed at the time of purchase and are subject to change. Payments are processed securely through Paddle, our payment processor.
By making a purchase, you agree to pay all applicable fees and taxes. All sales are final, except as described in our Refund Policy.
6. Intellectual Property
The Service, including its original content, features, and functionality, is owned by OurCast and is protected by international copyright, trademark, and other intellectual property laws.
Generated videos are provided for personal, non-commercial use only. You may not sell, license, or commercially distribute generated content without express written permission.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY RESULTS OBTAINED THROUGH THE SERVICE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OURCAST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
9. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
